Summary
Perpres 10/2021 sets out the business sectors open to investment and is known as the replacement for the Negative Investment List (DNI). Open sectors are divided into priority sectors; sectors allocated to, or required to partner with, cooperatives and micro, small and medium enterprises (UMKM); sectors with certain requirements; and other sectors open to all investors.
It revokes Perpres 44/2016 and was amended by Perpres 49/2021. Its annex answers the most important question for a foreign investor: whether the intended KBLI (business classification code) may be foreign owned, and what the limit on foreign shareholding is. That is why it should be checked before establishing a PT PMA, and read in its amended form.
