Summary
Law 33/2014 requires products that enter, circulate and are traded in Indonesia to be halal certified, so the obligation reaches imported goods as well as local production. It establishes BPJPH (the Halal Product Assurance Agency) to run halal assurance and regulates halal materials and processes, Halal Inspection Bodies (LPH), halal supervisors, the halal label, and administrative and criminal sanctions.
The certification flow under the Law: the business applies to BPJPH, an LPH inspects and/or tests the product, halal status is determined in a fatwa hearing, and BPJPH issues the certificate. Products made from non-halal (haram) materials are exempt from certification but must carry a non-halal statement. Several articles were amended through the Job Creation framework.
Key points for investors
- Source of the halal certificate obligation and its phased deadlines, implemented by PP 42/2024.
- Certification costs are borne by the business; micro and small businesses may receive facilitation.
- Halal locations, equipment and processes must be kept separate from non-halal ones.
